1. Acceptance of Terms
By accessing the Lake of Sunrise website (lakeofsunrise.org) or using the Email Tool tool provided to member organizations, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or tools.
These Terms apply to all visitors to the website and all members who access the Email Tool. Lake of Sunrise reserves the right to update these Terms at any time. Continued use of our website or tools following any update constitutes acceptance of the revised Terms.
2. About Lake of Sunrise
Lake of Sunrise is a non-governmental organization promoting artistic freedom across cultural communities. We operate the website at lakeofsunrise.org and provide the Email Tool tool to member organizations — a bulk email sending tool that allows members to communicate directly with their audiences, patrons, and decision-makers through their own Gmail accounts.
3. Email Tool Tool — Permitted Use
The Email Tool is provided exclusively to member organizations of Lake of Sunrise for the purpose of sending legitimate, permission-based communications to their audiences. By using the Email Tool, you agree to the following:
- You will only send emails to recipients who have a legitimate relationship with your organization or who have consented to receive communications from you
- You will not use the tool to send unsolicited bulk email (spam), phishing messages, or any content that is deceptive, fraudulent, or harmful
- You will not use the tool to send emails that violate any applicable laws, including but not limited to Canada's Anti-Spam Legislation (CASL), the CAN-SPAM Act, or GDPR where applicable
- You will not use the tool to send content that harasses, threatens, or discriminates against any individual or group
- You are solely responsible for the content of emails you send through the tool and for maintaining appropriate consent records for your recipients
- You will not attempt to circumvent Gmail's sending limits or use the tool in a manner that violates Google's Terms of Service
Lake of Sunrise reserves the right to suspend or terminate access to the Email Tool for any member who violates these terms, without prior notice.
4. Google Account Authorization
The Email Tool requires you to authorize access to your Google account via OAuth 2.0. By granting this authorization, you acknowledge that:
- You are authorizing Lake of Sunrise to send emails on your behalf using your Gmail account, solely as directed by you through the tool
- Lake of Sunrise will only access the Google account permissions you explicitly grant (
gmail.send,userinfo.email,userinfo.profile) - You may revoke this authorization at any time via myaccount.google.com/permissions
- Your use of Google's services through this tool is also subject to Google's Terms of Service
5. Member Accounts and Access
Access to the Email Tool is granted to verified members of Lake of Sunrise. As a member user, you are responsible for:
- Keeping your Google account credentials secure and not sharing access with unauthorized individuals
- All sending activity conducted through your account, whether initiated by you or by someone with access to your account
- Notifying Lake of Sunrise promptly at info@lakeofsunrise.org if you suspect unauthorized use of your account
6. Intellectual Property
All content on the Lake of Sunrise website — including text, design, graphics, and the Lake of Sunrise name and logo — is the property of Lake of Sunrise and may not be reproduced, distributed, or used without prior written permission.
Member organizations retain full ownership of the content they create and send through the Email Tool. Lake of Sunrise claims no rights over email content created by members.
7. Disclaimer of Warranties
The Lake of Sunrise website and Email Tool are provided "as is" without warranties of any kind, express or implied. We do not guarantee that:
- The tool will be available at all times or free from interruptions
- Emails sent through the tool will be delivered successfully (delivery depends on Gmail's infrastructure and recipient mail servers)
- The tool will be free from errors or bugs at all times
Lake of Sunrise is not liable for any loss or damage arising from your use of the website or the Email Tool, including but not limited to lost emails, sending failures, or account suspension by Google.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Lake of Sunrise shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the website or Email Tool. Our total liability to any member for any claim shall not exceed the amount paid by that member to Lake of Sunrise in the twelve months preceding the claim, or CAD $100, whichever is greater.
9. Termination of Access
Lake of Sunrise may terminate or suspend your access to the Email Tool at any time, with or without cause, including but not limited to violation of these Terms, abuse of the tool, or misuse of Google's services. Upon termination, your authorization to use the tool ends immediately. You may also terminate your use at any time by revoking our OAuth access via myaccount.google.com/permissions.
10. Governing Law
These Terms of Service are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
